Information on the processing of personal data

Baresh s.r.o. values your trust and places great emphasis on the protection of your data, including personal data, during its processing.

Dear Sir/Madam,

Baresh s.r.o. ("Baresh Reality") values your trust and places great emphasis on the protection of your data, including personal data, during its processing. Baresh Reality processes all personal data exclusively in accordance with legal regulations governing the protection of personal data and ensures the protection of personal data in accordance with applicable and effective legislation, which from 25 May 2018 is represented in particular by EU Regulation 2016/679 (General Data Protection Regulation, abbreviated as "GDPR"), which is supplemented in the Czech Republic by the accompanying Act on Personal Data Processing.

The aim of this statement is to inform about the processing of personal data that occurs in connection with visiting the Baresh Reality website, as well as about some other cases of personal data processing where Baresh Reality processes personal data of other persons (e.g. clients, journalists, etc.).

1. Processing of log files

1.1. Within the framework of access to its website, Baresh Reality processes log files about access to this website for the purpose of protecting its legitimate interests consisting in ensuring the protection of the website and improving its functioning.

1.2. Log files are thus processed without the consent of the website visitor and are stored for 1 month from the visit to the website.

1.3. The processing of these log files will be carried out by Baresh Reality itself. When processing log files, Baresh Reality processes the following data, which may (but need not) include personal data of the website visitor:

  • the website from which the visitor visited the Baresh Reality website;
  • IP address;
  • date of access and time of access;
  • any visitor query;
  • http response code;
  • transmitted data groups;
  • information about the browser and operating system of the website visitor's computer.

2. Processing of personal data for sending inquiries via newsletter and processing of personal data from inquiries from other websites

2.1. In case of interest of the website visitor in sending an inquiry via the contact form, Baresh Reality will process the provided personal data of such visitor for these purposes, always at least to the extent of the e-mail address and telephone number. If the visitor also provides Baresh Reality with their identification data (name, surname), Baresh Reality will also process this data for the stated purposes. The content of the newsletter may be personalized based on the provided data and other data for content personalization that Baresh Reality ascertains from the visitor's behavior on the website.

2.2. Baresh Reality will start processing the visitor's personal data only after the visitor fills in their data in the inquiry in the contact form and confirms the sending of the contact form. If the entry of the inquiry in the contact form is not confirmed, the data entered by the visitor into the form will be destroyed without undue delay. Personal data is processed due to a legitimate interest related to the registration and processing of the visitor's requests and for the purposes of capturing the visitor's expressions of will.

2.3. Baresh Reality is entitled to ask the website visitor how they will finance the purchase price of the real estate or cooperative share, for the purpose of fulfilling the obligation of Baresh Reality - intermediary resulting from § 2452 of Act No. 89/2012 Coll., Civil Code and fulfilling obligations resulting from Act No. 253/2008 Coll.

2.4. Personal data is processed until the newsletter subscription is revoked. The actual processing of the provided personal data will be carried out by Baresh Reality itself, or it will authorize a third party, in particular another company. Revocation of sending is possible by clicking on the "Unsubscribe from Newsletter" link in the sent newsletter.

3. Processing of personal data in connection with the sale, purchase, lease of real estate or cooperative share

3.1. In the event of concluding a mediation agreement, purchase agreement, purchase contract or delivery of ordered services, Baresh Reality will process the client's personal data to the extent of name, surname, e-mail address, telephone contact and address. For the purpose of preparing contractual documentation, Baresh Reality may require the provision of personal data to the extent of: bank connection and birth number. The company processes this personal data only for the purpose of preparing contractual documentation and does not process it further.

3.2. The processing of the above-mentioned personal data of clients will be carried out by Baresh Reality for the purpose of implementing the concluded mediation agreement, purchase agreement, purchase contract, delivery of ordered services, and last but not least also for the purpose of protecting its rights and legally protected interests consisting in protection against potential lawsuits arising from the concluded contracts or agreements mentioned above. Baresh Reality is entitled to ask the client who is buying how they will finance the purchase price of the real estate or cooperative share, for the purpose of fulfilling the obligation of Baresh Reality - intermediary resulting from § 2452 of Act No. 89/2012 Coll., Civil Code and fulfilling obligations resulting from Act No. 253/2008 Coll.

3.3. Baresh Reality makes and keeps copies of clients' identity cards, which the client provides only for the purpose of preparing contractual documentation and their unambiguous identification. Copies of clients' identity cards are not further processed by Baresh Reality. If making a copy of the document is not a necessary condition for providing the service, only a transcript of data from the identity card can be made.

3.4. Baresh Reality will process the above-mentioned personal data of customers for a period of 10 years from the conclusion of the relevant contract or agreement mentioned in point 3.1. The actual processing of the provided personal data will be carried out by Baresh Reality itself, or it will authorize a third party.

3.5. E-mail addresses and phone numbers of customers who conclude a contract or agreement mentioned in point 3.2 with Baresh Reality are further processed by Baresh Reality for the purpose of verifying customer satisfaction with the provision of services. The legal title for this processing of e-mail addresses and phone numbers is the protection of legitimate rights and interests of Baresh Reality consisting in ensuring feedback on the progress of service performance to customers and thus the possibility to improve its offer and services. This is therefore processing without consent, as without e-mail addresses and phone numbers of customers it would not be possible to ensure their feedback.

3.6. Baresh Reality will carry out the feedback and thus the processing of e-mail addresses and phone numbers of customers itself, or it will authorize a third party.

4. Processing of personal data during inquiry on the infoline

4.1. In the event of a client's inquiry on the infoline, Baresh Reality will process the provided personal data of such a client due to a legitimate interest related to the registration and processing of the client's requests and for the purposes of capturing the client's expressions of will, to the extent that such a client communicates in the call.

4.2. Baresh Reality is entitled to ask the client who inquires on the infoline how they will finance the purchase price of the real estate or cooperative share, for the purpose of fulfilling the obligation of Baresh Reality - intermediary resulting from § 2452 of Act No. 89/2012 Coll., Civil Code and fulfilling obligations resulting from Act No. 253/2008 Coll.

4.3. Baresh Reality will process the above-mentioned personal data of customers for a period of 3 years from the call mentioned in point 3.1. The actual processing of the provided personal data will be carried out by Baresh Reality itself, or it will authorize a third party.

5. Processing of personal data in connection with handling requests, inquiries and complaints

5.1. Baresh Reality values its customers very much and has therefore established a customer line. Through this customer line, customers and other persons can contact Baresh Reality with their inquiries and requests, either by phone, e-mail or via a shipment delivered by a postal service provider.

5.2. To answer inquiries and handle requests addressed to Baresh Reality, Baresh Reality will process personal data provided by the person who raised the inquiry or request. Baresh Reality will process such provided personal data only to the necessary (provided) extent and only until the inquiry or request is handled, unless there is a need to process personal data for another purpose (e.g. for the protection of rights and legally protected interests of Baresh Reality). These personal data are provided to Baresh Reality voluntarily, as without their knowledge Baresh Reality would not be able to handle the inquiry or request, and therefore it is processing without consent.

5.3. The processing of provided personal data will be carried out by Baresh Reality itself. If appropriate or necessary, Baresh Reality is entitled, due to legitimate interest, to transfer the processed personal data to its suppliers for handling the inquiry, request or complaint.

6. Processing of personal data in connection with providing consent for sending marketing or commercial communications

6.1. In case of client's interest in sending marketing or commercial communications, Baresh Reality will process, based on consent, the provided personal data of such visitor for these purposes, always at least to the extent provided by the client. If the visitor also provides Baresh Reality with their identification data (name, surname, date of birth), Baresh Reality will also process this data for the stated purposes.

6.2. Provided personal data is processed until the granted consent is revoked. The actual processing of the provided personal data will be carried out by Baresh Reality itself, or it will authorize a third party.

Consent to this processing of personal data is entirely voluntary and may be revoked at any time, both by sending a notice of revocation of consent in writing to the address of the registered office of Baresh Reality (see below), and also by sending a notice of revocation of consent to the email address info@baresh.cz. Without granting consent, sending advertising communications of Baresh Reality is not possible.

7. Use of cookies and website analysis

7.1. For the purpose of improving the functioning of its website, evaluating its traffic and for the purpose of optimizing marketing activities, Baresh Reality uses cookie files on its website. Cookie files are small text files that are stored locally on the computer via the browser, using which the website is displayed.

7.2. Cookie files do not serve and do not allow personal identification of website users. A list of all cookie files that Baresh Reality collects on its website is available here.

7.3. In the event that a website visitor does not agree to the collection of cookie files, they can prevent their collection by changing the settings of their browser. Instructions for deactivating and removing Cookies can be found in the help of the relevant browser, or contact the browser manufacturer.

Google Analytics and Google Adwords

7.4. To analyze websites using cookie files, Baresh Reality uses the Google Analytics Premium service, developed and operated by Google Inc., located at Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google").

7.5. Analysis using the Google Analytics service takes place in such a way that information about the use of the website created through collected cookie files is transferred to a Google server in the USA and subjected to appropriate analysis there. As a result of IP address anonymization, which is set on the Baresh Reality website, the IP address is shortened by Google before data transfer to the Google server in the USA, in one of the EU member states or the European Economic Area. Only in exceptional cases is the full IP address transferred to the Google server in the USA and shortened (anonymized) there.

7.6. Google will not associate the transferred data, including the shortened IP address, with other data. Google's privacy policy can be viewed here.

7.7. A website visitor can prevent the collection of cookie files and their analysis via the Google Analytics service by changing the browser settings as stated above, and also by: installing a plugin into the browser available here. This plugin works only in the relevant browser on the relevant computer and must not be deactivated or deleted after installation to maintain the deactivation of the Google Analytics service.

7.8. Within the Google Analytics service, Baresh Reality also uses related advertising functions provided by Google, such as overviews of views in the Google advertising network, extended reporting of anonymous demographic data (e.g. age, gender, interests) or displaying ads in the content network based on viewed products (so-called remarketing), including the Google AdWords service used to personalize advertising and improve ad targeting and so-called remarketing. Thanks to this, it can offer visitors to its website advertising content that will be as interesting as possible for them.

7.9. A visitor to the Baresh Reality website can turn off or adjust ad personalization via their Google account using the link available here.

Remarketing

7.10. Baresh Reality uses the following cookie files or pixels for marketing addressing of its customers, behavioral targeting, or retargeting:

  • FACEBOOK PIXEL from Facebook, which is managed by Facebook Inc., 1601 South California Avenue, Palo Alto, CA 94304, USA (www.facebook.com). You can prevent the use of this pixel by turning off cookie files according to Art. 7.
  • SKLIK.CZ from Seznam cz, a.s. (www.seznam.cz). You can prevent the use of this pixel by turning off cookie files according to Art. 7.
  • ADFORM Tracking pixel from ADFORM, which is managed by Wildersgade 10B, 1, Copenhagen 1408, Denmark (www.adform.com). You can prevent the use of this pixel by turning off cookie files according to Art. 7.

8. Use of social plugins

8.1. The Baresh Reality website also contains social plugins of third parties, using which website visitors can share content with their friends and other contacts. These are:

  • Facebook network plugin, which is managed by Facebook Inc., 1601 South California Avenue, Palo Alto, CA 94304, USA;
  • Youtube service plugin, which is managed by YouTube, LLC 901 Cherry Ave., 94066 San Bruno, CA, USA, a subsidiary of Google Inc., Amphitheatre Parkway, Mountain View, CA 94043;
  • Instagram service plugin, which is managed by Instagram Inc., 1601 Willow Road, Menlo Park, California 94025, USA.

8.2. Please note that these social plugins are not managed by Baresh Reality, which is thus not responsible for any processing of personal data by the above-mentioned operators (administrators) of these plugins or websites to which they refer, nor for their functionality and any damages that could be caused by them.

9. Processing of journalists' personal data

9.1. Journalists can contact Baresh Reality in connection with the performance of their profession via the e-mail address info@baresh.cz. In such a case, Baresh Reality processes their (provided) personal data for the purpose of handling the answer to their question.

9.2. Personal data is provided by journalists voluntarily and without their knowledge Baresh Reality would not be able to handle their question, therefore it is processing without consent. The answer to the journalist's question itself is stored in the Baresh Reality system for 90 days and is subsequently removed or anonymized. Identification data and the journalist's area of interest (e.g. construction of stores, informing consumers about products, etc.) are further processed by Baresh Reality for up to 2 years (from the end of active communication with the journalist) so that it can contact journalists in situations where it will be necessary for the protection of its rights and legally protected interests (e.g. for proper informing of the public). Personal data is therefore processed without the journalist's consent.

9.3. Processing of personal data will be carried out in this case by Baresh Reality itself, or for this purpose it will authorize, in accordance with applicable and effective legal regulations, a third party.

10. Other rights associated with personal data protection

10.1. When processing personal data by Baresh Reality, there is no decision-making based solely on automated processing that would have legal effects or would otherwise significantly affect data subjects whose personal data Baresh Reality processes according to this Privacy Statement.

10.2. Data subjects whose personal data Baresh Reality processes are entitled, upon fulfillment of the conditions set by legal regulations, to the following rights associated with the processing of their personal data:

  • (i) the right of access to personal data consisting in the right to receive free of charge upon request information about which of their personal data Baresh Reality processes;
  • (ii) the right to rectification of their processed personal data;
  • (iii) the right to erasure of their processed personal data;
  • (iv) the right to restriction of processing of their personal data;
  • (v) the right to portability of personal data;
  • (vi) the right to revoke the granted consent to the processing of personal data at any time, if consent is the legal basis for the relevant processing of personal data.

10.3. Data subjects whose personal data Baresh Reality processes also have, upon fulfillment of the conditions set by legal regulations, the right to object to the processing of their personal data if the legal basis for processing is the legitimate interests of Baresh Reality (i.e. in the case of processing personal data for internal administrative purposes of the Baresh Reality group or for protection against potential lawsuits).

10.4. The above rights, as well as complaints, can be exercised by data subjects whose personal data Baresh Reality processes in writing or by e-mail to Baresh Reality as the personal data controller, at the contact details listed below in Art. 10.

10.5. Users and other persons whose personal data Baresh Reality processes can also turn with their complaint to the supervisory authority, which is the Office for Personal Data Protection, located at Pplk. Sochova 27, 170 00 Prague 7, tel.: 234 665 111, web: www.uoou.cz.
